If an NJIT officer or employee recuses him/herself from a matter or is advised to recuse him/herself by the NJIT Ethics Liaison Officer because it is determined that an incompatible financial or personal interest exists, the recusal is absolute and the officer/employee must not have any involvement in the matter. The recusal must be put in writing and sent to the NJIT Ethics Liaison Officer. The writing must contain the following:
date of recusal;
reason for the recusal;
duration of the recusal;
instructions not to be contacted or requested to participate in the matter from which he/she has been recused;
identity of individual who will assume responsibility and authority for the matter; and
a list of any individuals who may be affected by the officer/employee’s recusal.
The Board Secretary, and other affected administrative personnel, must make diligent efforts to ensure that the NJIT officer/employee is not distributed materials involving a matter from which he/she is recused;
At the meeting, the NJIT officer/employee must place on the record his/her recusal and the reason for the recusal; and
The NJIT officer/employee must leave the room during the portions of the closed sessions in which the subject matter for the recusal is being discussed.
