Personal and Business Relationships Disclosure
N.J.S.A. 52:34-10.9 requires that officers and employees of the New Jersey Institute of Technology who are involved in the procurement process at NJIT or another State agency file disclosure statements about personal and business relationships. Involvement in the procurement process means drafting, reviewing, evaluating or making contract awards, substantively assisting in any of those tasks or authorizing payments under those contracts.
In the initial filing, NJIT officers and employees must disclose business, personal, and professional relationships for the period covering five years prior to the date of the disclosure. Annually, the officers and employees must review their Personal and Business Relationships Disclosure Form to ensure that it is correct and complete. A new Personal and Business Relationships Disclosure Form must be completed any time there is a material change in any section of the form.
A Personal and Business Relationships Disclosure Form has been developed by the New Jersey State Ethics Commission.
The completed Personal and Business Relationships Disclosure Form must be submitted to the NJIT Ethics Liaison Officer for review. The Ethics Liaison Officer must then submit the forms to the State Ethics Commission.
Types of Disclosures
There are three types of disclosures that must be recorded on the form:
- Disclosure of any interest in a firm, association, partnership, corporation or other business organization that has sought or been awarded a public contract with NJIT.
- Disclosure of any professional relationship with any person, firm, association, partnership, corporation or other business organization that has sought or been awarded a public contract with NJIT.
- Disclosure of any personal relationship with any principal officer or director of any firm, association, partnership, corporation or other business organization that has sought or been awarded a public contract with NJIT.
If you have a business, personal, or professional relationship with an entity or individual seeking to contract or do business, with NJIT, you must recuse yourself.
