SOLE SOURCE SUPPLIER: A sole source supplier refers to the exclusive reliance on one particular supplier for a specific good or service. A sole source supplier is characterized as having unique capabilities, specialized or proprietary technology or skill, or being the only provider in the market for a particular good or service. As a result, NJIT has no alternatives for sourcing the product or service from other suppliers and/or through competitive means.
Use of sole source suppliers should be limited to the extent possible as it carries risks for NJIT, such as dependency on a single source, vulnerability to supply disruptions, potentially providing less competitive pricing compared to sourcing from multiple suppliers and creating barriers to diversifying the university’s supplier pool.
Procurement of goods and services should occur through competitive means to the greatest extent possible. The Office of Procurement Services is readily available to provide guidance in this area upon request. Allowable exceptions may include utilizing State, Federal or cooperative purchasing or buying agreements that have been competed, or requesting to utilize a sole source supplier. If a situation arises that requires a sole source supplier, NJIT's Sole Source Justification Form must be completed and signed by all parties and reviewed by the Office of Procurement Services prior to the good or service being purchased or provided. This form is required to ensure transparency, fairness, and fiduciary responsibility in procurement at NJIT. Sole source justification helps avoid anti-competitive practices and ensures that NJIT is obtaining the best value while maintaining compliance with Federal and State regulations, as well as established policies and Grant guidelines. As a public research university, all claims of sole source are subject to audit, internal reviews and OPRA (Open Public Records Act) requests.
